I need to amend my title.

An application to Land Victoria (Titles Office) can be required where the dimensions on your land title do not accord with the existing fencing.

 

This is sometimes required when developing on or near boundaries which do not agree with fencing. It may also be required to remove warnings regarding dimensions on your title.


There are various sections of the Transfer of Land Act under which an application to amend the title can be made.

One of the most widely recognised is a Section 60 application to amend the title based on adverse possession. This is where you (or a chain of landowners) have continuously occupied a portion of land on another title for 15 years or more.

 

A solicitor or conveyancer will make the application. It will generally need to be a Licensed Surveyors Report, Field Records and a Plan of Survey, clearly showing the title boundaries, the fencing and the new proposed boundaries.
