Where is my Title Boundary?

If you’re conducting due diligence on a property you propose to purchase, erecting a new fence or building on or near your boundary, determining the position of title boundaries can be an essential early step. The cost will depend on the property's size, the age of the title and whether any registered survey information is available for the subject site or nearby properties.
 

For recent titles created under the Subdivision Act, this can be straightforward. Field Records showing survey marks that still exist on the ground should mathematically be connected to your title boundaries. By measuring these marks and your fences, we can position your title boundaries in relation to your fences.

There are often more complex issues involved in older titles.  

 

A re-establishment survey can involve connecting to numerous historical surveys, sometimes over 100 years old.  This can mean measuring fences and survey marks far removed from the subject site. Numerous pieces of legislation and various long-accepted survey principles may need to be considered and applied.

Subdivision

How can I divide my property into two or more lots?

Whether you want to keep an existing dwelling and sell off some unused backyard or develop a large parcel of land, a Plan of Subdivision must be prepared by a Licensed Surveyor to effect a legal subdivision which creates multiple titles.

 

The Plan of Subdivision can be registered at Land Victoria (Titles Office) once compliance with Council and service authority requirements is completed.

From assessing town planning issues to final consent from Council, we can assist with:

Set Out Survey

I need some marks in the ground for my build.

We can interpret your design and translate that onto the ground for your contractors. This may be for residential units, commercial or industrial buildings.

We can mark the building footprint on the ground based on supplied data.

Feature & Level Survey

I need a plan of my property for planning/design.

Whether you are proposing a residential renovation, a new dwelling, a multi-lot development, or an infrastructure project, you may need a survey to inform the design.

 

We can locate significant features and levels on the subject site and provide a plan/map in pdf and digital format. We can also locate details on neighbouring properties remotely where required.

We can supply existing conditions and site analysis plans for Council permit applications as well as plans and data for architectural and infrastructure design.

Application Survey

I need to amend my title.

An application to Land Victoria (Titles Office) can be required where the dimensions on your land title do not accord with the existing fencing.

 

This is sometimes required when developing on or near boundaries which do not agree with fencing. It may also be required to remove warnings regarding dimensions on your title.


There are various sections of the Transfer of Land Act under which an application to amend the title can be made.

One of the most widely recognised is a Section 60 application to amend the title based on adverse possession. This is where you (or a chain of landowners) have continuously occupied a portion of land on another title for 15 years or more.

 

A solicitor or conveyancer will make the application. It will generally need to be a Licensed Surveyors Report, Field Records and a Plan of Survey, clearly showing the title boundaries, the fencing and the new proposed boundaries.
